What is Manslaughter?

Manslaughter is a crime that occurs when an individual inadvertently kills another human being without malice or planning. Manslaughter is commonly charged in a wide variety of unfortunate situations such as car accidents and DUI, assault cases or in situations where an individual experiences a loss of control as a result of extremely traumatic circumstances, and inadvertently commits homicide.

In Georgia, manslaughter is classified into two categories: voluntary and involuntary. Voluntary manslaughter occurs when a person kills another in the heat of passion due to serious provocation and is punishable by one to 20 years in prison. Involuntary manslaughter, which happens when someone unintentionally causes another’s death while committing an unlawful act (not a felony) or a lawful act in an unlawful manner, carries penalties of one to 10 years in prison if it is a felony offense. If charged as a misdemeanor, it can result in up to one year in jail and fines. Penalties can vary depending on the circumstances, criminal history, and legal defense presented in court.

There is a fine line between proving murder and proving manslaughter, and it is the burden of prosecution to prove that an accused offender killed the victim with prior intent, or whether the victim was killed in the heat of the moment or as a result of an accident. If an individual has been charged with manslaughter and not murder, it may be because the authorities recognize they do not have sufficient evidence to prosecute a murder charge for the particular circumstance or available evidence. In many case, prosecution may opt to pursue a murder charge in hopes that a plea bargain will at least warrant a manslaughter conviction.
